Article 3 – Applicability
These terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
Before concluding the distance contract, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the conclusion of the contract that the general terms and conditions are available for review at the entrepreneur’s location, and will be sent to the consumer free of charge upon request.
If the distance contract is concluded electronically, the text of these terms and conditions may be made available to the consumer electronically before the contract is concluded, in such a way that it can be easily stored on a durable data carrier.
If specific product or service terms and conditions apply in addition to these general terms and conditions, the second and third paragraphs apply accordingly, and in case of conflicting terms, the most favorable provision for the consumer will apply.
If one or more provisions of these terms and conditions are found to be void or unenforceable, the contract and these terms and conditions remain in effect. The relevant provision will be replaced through mutual agreement with a provision that closely resembles the original.
Unforeseen situations will be evaluated in the spirit of these general terms and conditions.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be clearly stated in the offer.
The offer is non-binding. The entrepreneur is entitled to change and adapt the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the consumer to make a well-informed judgment of the offer. Any images are a true representation of the products and/or services offered. Obvious mistakes or errors in the offer do not bind the entrepreneur.
All images and specifications are indicative and cannot be grounds for compensation or contract cancellation.
Each offer contains sufficient information to make clear to the consumer what rights and obligations are associated with accepting the offer.
Article 5 – The Agreement
The agreement is concluded, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and complies with the conditions set out in the offer.
If the consumer accepts the offer electronically, the entrepreneur will confirm the acceptance of the offer electronically without delay.
The entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment.
The entrepreneur may, within legal limits, check the consumer's creditworthiness and all factors that are important for responsibly entering into the distance contract.
Article 6 – Right of Withdrawal
When purchasing products, the consumer has the option to cancel the agreement without providing any reason within 14 days.
During the cooling-off period, the consumer will handle the product and packaging carefully.
If the consumer exercises their right of withdrawal, they will return the product with all supplied accessories and, if reasonably possible, in the original condition and packaging.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises their right of withdrawal, the return shipping costs will be borne by the consumer.
Any amounts already paid will be refunded as soon as possible, but no later than 14 days after withdrawal.
Article 8 – Exclusion of Right of Withdrawal
The entrepreneur may exclude the right of withdrawal for products made according to the consumer's specifications or clearly personal in nature.
Article 9 – Price
During the validity period stated in the offer, the prices of the offered products and/or services will not be increased, except for price changes resulting from changes in VAT rates.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications mentioned in the offer, and the legal requirements.
Article 11 – Delivery and Performance
The entrepreneur will exercise the utmost care in receiving and processing orders for products.
The delivery address will be the address the consumer has provided to the entrepreneur.
Article 12 – Duration Contracts: Duration, Termination, and Renewal
The consumer may terminate an agreement that has been concluded for an indefinite period at any time, observing a notice period of no more than one month.
Article 13 – Payment
Unless otherwise agreed, the amounts owed by the consumer must be paid within 7 days.
Article 14 – Complaints Procedure
Complaints must be submitted to the entrepreneur fully and clearly within 7 days.
Article 15 – Disputes
These terms and conditions and the agreements between the entrepreneur and the consumer to which they apply are governed by Dutch law. Any disputes arising from these agreements shall be resolved in accordance with Dutch law.
